Please read these Terms of Service ("Terms") carefully before using the FitPanda mobile application (the "App") operated by FitPanda ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms.

1. Agreement to Terms

By downloading, installing, or using FitPanda, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 13 years of age to use FitPanda. If you are between 13 and 17 years old, you must have parental or guardian consent to use the App. Parents and guardians are responsible for supervising their minor's use of the App and for all activities under their account.

3. Health, Nutrition, and Safety Disclaimers

FitPanda does not provide medical advice, nutritional counseling, or professional health services. The App is a tool for tracking food intake and general wellness information only.

Calorie estimates, macro breakdowns, and nutritional values provided by the App (including AI-powered food scanning) are approximations only and may not be accurate. These estimates should not be relied upon for medical dietary requirements.

4. Account and Data

FitPanda stores all your data locally on your device. We do not create user accounts or store your personal data on our servers. You are responsible for maintaining the security of your device. If you delete the App, all your data will be permanently lost and cannot be recovered.

5. User Content

You may submit content to the App including food photos, progress photos, and meal logs ("User Content"). You retain ownership of your User Content.

When you use the food scanning feature, you grant us a limited license to send your food photos to our AI processing service solely for the purpose of identifying food items and estimating nutritional content. Food images are processed in real-time and are not stored on our servers.

Progress photos remain on your device at all times and are never transmitted to any external service.

7. Subscriptions and In-App Purchases

FitPanda offers a premium subscription ("FitPanda Pro") available as monthly or yearly plans, with a free trial period.

Free Trial: New subscribers may be eligible for a free trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Billing: All subscription purchases and payments are processed through the Apple App Store. By subscribing, you agree to Apple's terms and payment policies.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's Settings > Apple ID > Subscriptions.

Refunds: Refund requests are handled by Apple according to their refund policy. We do not have the ability to process refunds directly. To request a refund, visit reportaproblem.apple.com.

Price Changes: We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing cycle after notice.

8. Intellectual Property

The App, including its design, code, graphics, panda mascot character, features, and content, is owned by FitPanda and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

9. Third-Party Services

The App integrates with third-party services including OpenAI (food analysis), Open Food Facts (barcode lookup), USDA FoodData Central (food search), Apple HealthKit (activity data), and RevenueCat (subscription management). We are not responsible for the content, privacy policies, or practices of these third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FITPANDA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH COMPLICATIONS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability to you for any claims arising from or related to these Terms or the App shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

12. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitPanda operates, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding individual arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
